Website purpose and quote-only model

The website is an information, catalogue, planning and enquiry platform. It does not currently accept online payment or automatically conclude an online sale. Adding a product to an enquiry, using a calculator, submitting a form or receiving an automated acknowledgment does not create an order, reserve stock or bind BBC to supply goods.

Authority to submit an enquiry

If you submit an enquiry for a company, property or other organisation, you confirm that you are authorised to provide the information and communicate about the requirement. You must provide accurate, current and complete information and must not impersonate another person or organisation.

Quotations and formation of an order

A supply agreement is formed only when BBC issues or approves a written quotation or order confirmation, the customer accepts it in the required manner, BBC receives the required payment and all specifications and approvals are complete. BBC may decline an enquiry or withdraw or correct a quotation before acceptance. The accepted quotation, order confirmation and product-specific documents prevail over general website information if there is a conflict.

Product information and customer approval

BBC takes reasonable steps to present accurate product information, but website images are illustrative, screens may display colours differently and product specifications or supplier ranges may change. Generic size names do not guarantee fit. Before accepting an order, the customer must approve the exact product, material, construction, finished dimensions, thread count or GSM where relevant, colour, quantity, branding, intended use and other specifications stated in the quotation.

Supplier brands and product instructions

Comphy and other approved supplier products remain subject to the applicable manufacturer or supplier specifications, availability, care instructions, safety information and product-specific terms. Website information is not a substitute for product-specific professional or technical advice.

Availability, substitutions and corrections

Products are subject to material, production, supplier, import and logistics availability. BBC may correct errors, update specifications, replace website images, withdraw a product or propose a documented alternative before a binding order is formed. BBC will not substitute an accepted material specification or product without the customer’s required approval.

Prices, tax and payment

Unless expressly stated otherwise, website information is not a price offer. The final price, currency, taxes, payment stages and validity period are stated in the written quotation. BBC is not currently registered as a VAT vendor and does not currently charge VAT. This statement must be updated if BBC’s VAT status changes.

Delivery, returns and warranty

Delivery is governed by the accepted quotation and BBC Delivery Policy. Returns, refunds and warranty claims are governed by the BBC Returns and Refunds Policy, BBC Warranty Policy, applicable product-specific supplier terms and mandatory law.

Linen calculator and planning tools

Any calculator, estimate, comparison, replacement-life illustration, energy calculation or planning output depends on the information and assumptions used. It is not a quotation, audit, warranty, financial advice, guaranteed saving or promise of product performance. The customer must verify the assumptions against its own operating records and the exact product information in the written quotation.

Permitted website use

BBC grants you a limited, revocable, non-exclusive and non-transferable right to access the website for lawful personal use or internal business evaluation. No other right or licence is granted.

Prohibited conduct

  • Using the website for an unlawful, fraudulent, harmful or misleading purpose.
  • Interfering with website operation, security, availability or another user’s access.
  • Attempting unauthorised access to accounts, systems, source code or data.
  • Introducing malicious code, automated attacks or harmful material.
  • Scraping, harvesting, data-mining or systematically extracting protected content without written permission.
  • Submitting false information, impersonating another person or infringing privacy, intellectual-property or other rights.
  • Copying, republishing, selling or commercially exploiting website content except with written permission or as permitted by law.

Intellectual property

The BBC name, logos, heritage materials, original text, page design, layout, graphics, calculators, databases, product organisation and other content created or owned by BBC are protected by applicable intellectual-property law. Supplier names, trademarks, logos, product images, catalogues and technical materials, including Comphy materials, remain the property of their respective owners and are used by BBC under permission, licence or another lawful basis.

You may view or print a reasonable extract solely for your own evaluation of a potential BBC purchase. You may not remove ownership notices, modify protected content, reproduce substantial parts of the website, use supplier images independently, create derivative commercial material or imply endorsement or affiliation without prior written permission from the relevant rights holder.

Information submitted to BBC

You retain ownership of information and materials you lawfully submit. You grant BBC a limited right to use, copy and share them with relevant employees, advisers, suppliers, manufacturers and logistics providers only as reasonably required to answer the enquiry, prepare a quotation, assess specifications, fulfil an accepted order or provide support. You confirm that you are entitled to provide the material and that its authorised use will not infringe another person’s rights.

Third-party services and links

The website is hosted through Shopify and may use BobGo, courier, analytics, consent, form, hosting or other third-party services. Third-party services operate under their own terms and privacy practices. A link does not mean BBC controls or endorses all third-party content. BBC is not responsible for independent third-party content, availability or conduct, except to the extent that responsibility cannot lawfully be excluded.

Website availability and security

BBC does not guarantee that the website will always be available, uninterrupted, error-free or free from every harmful component. BBC may suspend, restrict or change the website for maintenance, security, legal, supplier or operational reasons. You are responsible for appropriate device, browser, network and security controls.

Disclaimer

The website and its general content are provided for preliminary information and enquiry purposes. To the maximum extent permitted by law, BBC does not warrant that general website information is complete for every property, purpose or operating condition. Only specifications and commitments expressly included in an accepted written quotation or order confirmation form part of the supply agreement.

Limitation of liability

Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by liability that cannot lawfully be excluded, or any statutory right or remedy that cannot lawfully be limited.

Subject to that protection and to the maximum extent permitted by law, BBC is not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, opportunity, anticipated saving, goodwill or data arising solely from website use, website unavailability, reliance on unconfirmed website information or an independent third-party service.

Where the customer is a business and applicable law permits limitation, BBC’s aggregate liability arising from an affected supply will not exceed the amount paid to BBC for the specific affected goods or service giving rise to the claim. This limitation does not reduce a remedy expressly required by mandatory law or the accepted written warranty.

Customer responsibility and indemnity

You are responsible for information, specifications and materials you provide and for using products according to approved instructions. To the extent permitted by law, a business user indemnifies BBC against a third-party claim arising directly from that user’s unlawful website use, unauthorised material, false information or product misuse, except to the extent caused by BBC’s own unlawful conduct or fault.

Events beyond reasonable control

BBC is not responsible for failure or delay caused by an event beyond its reasonable control, including supplier or production disruption, import or customs action, courier disruption, industrial action, natural disaster, severe weather, epidemic, war, civil disturbance, infrastructure failure, power or telecommunications failure or government action. BBC will take reasonable steps to communicate and manage a material effect, subject to applicable law.

Privacy and cookies

BBC processes personal information according to the BBC Privacy Policy and uses cookies and similar technologies according to the BBC Cookie Policy. Where consent is required, non-essential analytics or marketing technology must not activate before the relevant consent choice.

General legal provisions

If a provision of these terms is invalid or unenforceable, the remaining provisions continue to apply. A failure or delay in enforcing a right is not a waiver. You may not transfer your rights or obligations under these website terms without BBC’s written consent. Headings assist reading and do not limit interpretation.

Governing law and disputes

These website terms are governed by the laws of the Republic of South Africa. The parties submit to the jurisdiction of the competent South African courts, subject to any mandatory consumer or statutory dispute-resolution right. Before formal proceedings, the parties should first attempt in good faith to resolve the matter through written communication where appropriate.

Changes and contact

BBC may update these website terms by publishing a revised version and effective date. Changes apply prospectively unless the law requires otherwise and do not alter an already accepted order except as lawfully agreed. Questions may be sent to steven.w@bathroomboutique.co.za or +27 72 396 5170.
